Shri Shridhar Joshi is a retired Indian Administrative Service officer. After retiring from the post of Secretary in the Food and Civil Supplies Department of the State Government, he served for five years as a Member and Vice-Chairman of the Maharashtra Administrative Tribunal. He has previously authored the books ‘Disciplinary Proceedings – Why Administrative Tribunals Interfere’ and ‘Maharashtra Civil Services (Discipline and Appeal) Rules, 1979’, both of which have been published by YASHADA. At present, he provides free guidance to government officers and employees on administrative issues through the Free Advisory Cell at YASHADA. The sixth edition of his book titled ‘Maharashtra Civil Services (Discipline and Appeal) Rules, 1979 (Disciplinary Proceedings)’ has recently been published. Maharashtra Civil Services (Discipline and Appeal) Rules, 1979 – About the Book…
The sixth revised edition of the book ‘Maharashtra Civil Services (Discipline and Appeal) Rules, 1979’ has recently been published by YASHADA. The key features of this edition are as follows:
1) Updated Rules: This edition includes all amendments made up to 1 December 2025, providing the updated Maharashtra Civil Services (Discipline and Appeal) Rules, 1979. Brief notes have been added below the rules to clarify the provisions.
2) Important Government Resolutions and Circulars: After the fifth edition of the book, the Government has issued several important resolutions and circulars. This edition includes all significant Government Resolutions and circulars related to disciplinary proceedings issued up to 1 December 2025.
3) New Chapters: The following new chapters have been included in the sixth edition:
Disciplinary Proceedings – Constitutional Provisions (Article 311)
This chapter includes frequently asked and possible questions along with their answers regarding compliance with these provisions.
Disciplinary Proceedings – Important Judicial Decisions
Various important judgments have been delivered by the Supreme Court, High Courts, and Administrative Tribunals in relation to disciplinary proceedings. This chapter provides a list of 26 selected important judgments. It also indicates the corresponding video numbers on the author’s YouTube channel ‘Karmachari va Adhikari Mitra’ where these judgments are explained. These decisions can be understood and downloaded by visiting the channel.
Pending Departmental / Judicial Proceedings – Promotion Process – Related Issues
If departmental or judicial proceedings are pending against an officer or employee, promotion is withheld and the recommendations of the Promotion Committee regarding the eligibility of the concerned officer/employee are kept in a sealed cover. In this regard, the Government has issued two important resolutions dated 15 December 2017 and 30 August 2018. This chapter addresses possible questions and answers related to promotions in such cases.
Pending Departmental / Judicial Proceedings and Retirement Benefits
If departmental or judicial proceedings are pending against an officer or employee at the time of retirement, regular pension is not granted; only provisional pension is provided, and gratuity is withheld. This chapter discusses in detail the retirement benefits admissible in such cases.
‘Karmachari va Adhikari Mitra’ – A Useful YouTube Channel
The YouTube channel ‘Karmachari va Adhikari Mitra’ was started in 2020. More than 500 videos have been published on topics of importance to employees, such as disciplinary proceedings, seniority, promotions, retirement benefits, and compassionate appointments. Along with providing information on these subjects, the channel also offers access to relevant Government Resolutions, circulars, and judicial decisions to its subscribers.
